About the Cook/Kiley and Beckman Receiverships

 

On June 12, 2012, the jury in the criminal case against Jason Bo-Alan Beckman, Gerald Joseph Durand, and Patrick Joseph Kiley (Case No. 11-cr-228) returned a verdict of guilty as to each defendant on all charges. On January 3, 2013, Chief Judge Michael J. Davis sentenced Mr. Beckman to 30 years in prison for his role in the scheme, Mr. Durand to 20 years, and Christopher Pettengill (Case No. 11-cr-192) to 7.5 years. On July 15, 2013, Judge Davis sentenced Mr. Kiley to 20 years.  More information about the criminal cases can be found on the U.S. Attorney's website here.

On November 23, 2009, Chief Judge Michael J. Davis established a Receivership in the cases of United States Securities & Exchange Commission v. Cook et al., 09-cv-3333 (D. Minn.) and United States Commodities Futures Trading Commission v. Cook et al., 09-cv-3332 (D. Minn.). R.J. Zayed, a partner with Dorsey & Whitney, LLP and a former Assistant United States Attorney in the United States District Court for the District of Minnesota, is the appointed Receiver in both actions and Carlson Caspers is representing him in his capacity as Receiver.

On March 8, 2011, Chief Judge Michael J. Davis also appointed R.J. Zayed as a Receiver in the case of United States Securities & Exchange Commission v. Beckman et al., 11-cv-00574 (D. Minn.).

The duties and responsibilities of the Receiver are fully defined in the Court Orders in each case. The Receiver will file periodic Receiver Reports in each case.
